The Last Will and Testament o f EphraimAndrews In the name of God, amen. Item. I, Ephraim Andrews of WilliamsonCounty do ap point and ordain this to be my last will and testament.

Item. I lend to my beloved wife, Ann Andrews, the whole of my estate,both real and personal d uring her life or widowhood.

Item. And all the rest of my estate both real and personal after mywife's decease or widowhoo d, I desire should be equally divided amongstmy six children, to wit; George , Knacy H., Ephr aim, Stacy, Elizabeth andNancy, with the following exceptions to wit;

Item; I give and bequeath to my beloved wife the sum of six hundred andeighty two dollars, t o be disposed of as she may think proper.

Item. I give and bequeath to my son Knacy Andrews a tract of landcontaining one hundred acre s joining Benjamin Buggs line, running on hisown line for (compliment?).

Item. I give to son Ephraim Andrews one half of the tract of land I nowlive on.

Item. I lend to my daughter, Elizabeth YOUNG, the other half of the landthat I now live on, j oining 73 acres and (Beggers?) line.

Item My will and desire is that (Pat, Vine & Nelson?) wit h theirincrease and whatsoever par t of my estate or the produce of it as mayfall to the share of my daughter Elizabeth, then t o remain in the handsof my Executors, hereafter named, as long as her present husband shallli ve, and at his death, her part of my estate is to be delivered by themto her, or in case of h er dying before him, my executors are herebyrequired and empowered to divide her part o f m y estate equally amongsuch children as she may leave, except Rebeckah Kyle, to which my desir eis that she may have but one dollar.

Item. I give and bequeath to my Grandson Howard YOUNG the s um of tenpounds cash to be laid o ut for him at the discretion of my executors,after my wife's decease.

Item. My will and desire is that the price with the hire o f one negrofellow named Tom that i s now in the possession of George Andrews andWilliam Drumwright, shall be taken out of thei r part of the estate, andthe two hundred dollars that George Andrews paid the said Drumwrigh t forTom is to be subtracted out of the said Drumwright's part of said negro.

Lastly, I appoint my beloved wife Ann, my son Knacy, and Benjamin Bugg toexecute this, my las t will and testament. In witness, whereof, I havehereunto set my hand and seal this eighteent h day of July, one thousand,eight hundred and seven. Signed and sealed and pronounced by th e testatora s his last will and testament, in presence of each other havesubscribed our names :

Which foregoing recited will and testament was duly prove n in open courtJanuary session, 180 9, by the oaths of miles Malone and William Baring,the subscribing witnesses thereto, to be t he act and deed of EphraimAndrews for the us e and purposes therein expressed. At which sessi onBenjamin Bugg qualified as executor and at April session 1809 Ann Andrewsand Knacy Andrew s came into court and qualified likewise and receivedletters Testamentory.

Information related to Ephraim Andrews' estate after his death.

Note: After the death of Ephraim Andrews Sr. in 1808, the will wasapparently not probated unt il after the death of his wife, Ann, in 1811.Benjamin Bugg also died, leaving Knacy Andrews a s the sole survivingexecutor. Apparently, he did not satisfy the terms of the will, and after the death of his sister Elizabeth Young (in 1818), her children filed incircuit court to hav e Knacy Andrews provide an accounting of the proceedsof the estate of Ephraim Andrews, and t o 'come up' with the share of theproceeds which right fully belonged to Elizabeth Young, or h er estate.The handwriting of this document is almost unreadable, so some words maynot be corr ect, and many are just left out (......). I believe, however,that what is here speaks for its elf. To the Honorable Judge of the FourthDistrict Court of t he State of Tennessee. This bil l of complaint ofWilliam Young, administrator of the estate of Elizabeth Young, dec'd ,and Fr ancis Young, Thomas Young, Ephraim Young, Michael Young, HowardYoung by his guardian Willia m Young, Joseph Young and Elizabeth his wife,George Ridley and Martha his wife, Obadiah Drisk ill and Nancy his wife,and William Kyl e and Rebecca his wife, heirs of Elizabeth Young,decea sed , complainants against Knacy Andrews, surviving executor o f thelast will and testament o f Ephraim Andrews dec'd., defendant. Humblycomplaining, showeth unto your honor, your orator s and oratrixes, thatmany years ago, this ancestor and grandfather, Ephraim Andrews departedt his life having a last will and testament duly executed, a copy of whichsaid will is hereto a ttached (marked A, and prayed to b e made a part ofthis file) which said will was afterwar d s in due time and form found andrecorded in the county in which said testator died, and Kna cy Andrews andBenjamin Bugg the executors named in said will therefore complied withthe requi rements of the law in such cases, and too k upon themselves theexecution of the said will an d since that time Benjamin Bugg, one of thesaid executors died , leaving the said Knacy Andre ws sole survivingexecutor o f said last will and testament. And your orator and oratrixesfurt her show unto your honor that the said Knacy took possession of, andyet maintains possessio n of a ? part o f the property belonging to theestate of the said testator and the proceeds o f the same which wasbequeathed and ordained by the said testator to his daughter, ElizabethYo ung and to her children upon the contingency happening, which ismentioned in said will, tha t your orators and oratrixes mother, ElizabethYoung is dead, and your orator Wm. Young ash be en duly appointedadministrator of her estate at the time of her death, and according tothe pr ovisions of the said will all the property designated therein andall that might have descende d to her and did descend to her upon thedeath of her, the said Elizabeth's mother, Ann Andrew s, with all theproceeds and property thereof rightfully and lawfully belongs to yoursaid orat or and oratrixes in equal portions except the portion of WilliamKyle and Rebecca , his wife , who are entitled to a specified sum of money. And your orator and oratrixes further show un to your honor that aconsiderable sum of money remains in the hands of the said defendant,unac counted for and which your orator and oratrixes are rightfullyentitled to receive, and your o rator and oratrixes have several timesapplied themselves to the said defendant for a settleme nt andsatisfaction of these claims, but the said Knacy knowlingly, and withduress offers pers ons at present unknown to your orator and oratrixes,whose names when discovered they pray ma y be liable parties to this bill,with apt words to charge them, how to wrong and injure you r orator andoratrixes; he sometimes gives out that he has claims upon the estate o fthe sai d Elizabeth Young, by means of which they are delayed andprevented from receiving their jus t division all which things and doingsof the defendant; and his confederate s are contrary t o equity and goodconscience and, true t o the ...and .....of your orators and oratrixes,who a re only properly ..... in a court of equity. To......that the saidKnacy Andrews may ....and p erfect answer make to all an d each of theitems charged in this, your orators and oratrixes b ill of complaint, asfully and positively as if the same were herein adjoined.... That he mays et forth and describe what amount, kind and description of money,property or other and ever y kind of stock have come into his hands as tohis having possession, or of others and at wha t time the same will awardand how he has managed or disposed of the or any part of the monie s andproperty with the proceeds and ....thereof which of right belongs as a... . . to your sa id orators and oratrixes under the said last will andtestament of the said Ephraim Andrews, d eceased , and that the said Knacymay set forth, and a full and perfect account of the said mo nies,property, and profits of the said estate so belonging to your orators andoratrixes , an d that he, the said Knacy may be compelled under orders ofthe honorable court to pay ....an d disburse to your orators andoratrixes, whatever amount of monies and property may be foun d to be dueand coming to them, and that your orators and oratrixes may have suchother and fur ther relief, as all and singular the premises aforesaid, asthe .. ..and circumstances of thi s case may .....and as to your honorshall deem most proper.


May it please your honor to grant the gracious writ of subpoena toanswer, and your orators an d oratrixes as in duty bound will we pray.Filed February session, 1820.

Note: Ed Driskell also has, among many court documents, the answer tothis lawsuit filed by Kn acy Andrews. It is even more difficult to readthan the previous documents, and my eyes just w on't do it. However, thedocument does, on several occasions, mention John Young, and that Joh nand Elizabeth Young were the parents of the complainants. The names oftheir children, and la ter, Nancy and Obadiah Driskill 's children, arenames common to the family of Michael Cad e t YOUNG, of Brunswick CountyVA. Although no connection has yet been found (on paper) it wou ld beappropriate to assume that John Young descends from this heralded family.There is also n o mention of where John Young was, but it seems that hewas not present at the time of Elizabe th Andrew s Young's death in 1818.

In the April session of 1820, William Young also sued Ephraim Andrews Jr., for $1350 purporte dly for properties from the estate of Ephraim AndrewsSr. which he had sold, an d had not disb ursed the proceeds. Otherlawsuits followed, with the final disposition of the estate in 1826.
