Benjamin left no will. His Inventory was reported February 1773, so heprobably died in 1772 . Sylvester Andrews qualified as the executor ofBenjamin's estate as his widow , Ann (Vaden ) Andrews refused to qualify.In January 1780 , Sylvester sold to Bullard Andrews, 100 acres o f land(Chesterfield County, VA, Deeds, Book 9, Page 275) that was "t he Landthat Benjamin And rews, Deceast had of Marke Moore Deceased" (HenricoCounty, VA, Wills & Deeds, 1744-1748 , pag e 67) . I take this to meanthat Sylvester was the oldest son and in the absence of a will an d underthe law o f primogeniture at the time, he was entitled to the estate ,except that whic h was given by the court to Ann (Vaden ) Andrews aftershe refused to qualify as executrix o f Benjamin's estate.
